CONDITIONS OF SALE
1. The highest accepted bidder shall be the Purchaser immediately the lot/lots have been
knocked down to him/her. Should any dispute arise between two or more bidders, the
lot in dispute will be put up again and be resold, or the Auctioneer may declare the
Purchaser. The Auctioneer's decision in all cases is final. All goods are sold 'voetstoots'.
2. The Auctioneer does not hold himself responsible for any errors of description. A bid
shall be taken as proof that the bidder has made himself acquainted with the lot for
which he bids.
3. TERMS: Cash. All accounts must be paid immediately at the conclusion of each day's
sale. Ownership of the goods sold vest at all times in the Auctioneer's principal until
payment in full has been made. Cheques rendered will not be accepted as cash until
paid by the bank.
4. The Auctioneer's vendue Roll of Sale is FINAL. No dispute will be taken in
consideration as to the correctness of same.
5. We reserve the right to withdraw any lot before the sale, to divide or combine any of
the lots, to refuse bids, regulate the bidding or reject an offer and withdraw the lot in
question from the sale or sell the lot subject to confirmation.
6. Care is taken to ensure that any statement as to the origin, date, age, attribution and
condition is reliable and accurate, but all such statements are statements of opinion and
are not representations of fact.
7. Although we will execute commission bids and accept telephone bids as a convenience
to clients who cannot be present at the auction, we are not responsible for any errors
or omissions in connection herewith. Telephone commission bids must be confirmed in
writing or by fax prior to the auction.
8. In the event of legal proceedings being instituted, the Auctioneer shall be entitled at
his option to institute such proceedings in the Auctioneer's name, whether or not he is
acting as agent.
9. The signatory hereto, by his signing hereof, shall ipsofacto be deemed to have bound
himself to the Seller as Surety and Coprincipal Debtor for the obligation of the
Purchaser.
10. A premium of 10% of the Hammer Price is payable on all lots and the premium is subject
to VAT at the standard rate.
